South African Gambling Lawsuit
The
High Court of South Africa is hearing a
case today regarding an internet
gambling site. The Supreme Court of
Appeals in Bloemfontein is listening to
a case involving a company called Casino
Enterprises, but the lawsuit pertains to
their subsidiary Piggs Peak Online
Casino.
Casino Enterprises wants to receive a
judgment that says the site is legal
because it is located in Swaziland, not
in South Africa. You can access the site
in South Africa, but its servers are not
located there – and therefore the
company says they are within their legal
rights to continue operating the site.
They claim to be part of the common
monetary area and therefore not
They say that they are regulated by the
Swaziland Gambling Board, and that they
are perfectly legal. The company runs
other gambling subsidiaries as well, but
this is the one in question. A judge
previously ruled that they had to
redraft their petition as it did not
originally disclose why they wanted the
order.
With Hartzeberg’s ruling sitting there
while the casino redrafts the documents,
both sides are saying that they are
winning. Those opposed to the casino,
such as the National and Gauteng
Gambling Boards say that they will be
able to go after online casinos now.
Those supporting the casino say that
this just proves that their activities
were legal.
