San Pasqual
Tribe is Suing California
The
San Pasqual Band of Mission Indians is
suing the state of
California. They
are seeking $115 million in profits that
they say that the state kept from them,
and they want to be paid. They say that
the governor of the state denied them
slot machines that were rightfully
theirs and now that a judge has made it
official, it is high time that they were
paid back for their lost winnings.
They
have filed a lawsuit claiming that
Governor Arnold Schwarzenegger denied
them the right to have slot machines
that should have been theirs all along.
They said that the governor refused to
grant them their slot machine licenses.
Last year a federal judge ruled in favor
of the tribes saying that the governor
was illegally withholding those slot
machine licenses.
They
say that the state breached their 1999
contract with the tribes and interfered
with their ability to provide the slot
machines to their patrons. They said
that they needed the additional slot
machines to bring in the income that
they needed during these tough economic
times. They allege that he denied income
in the form of up to $30 million for
counties and cities that could have used
it.
They
said that they had been fighting for the
slot machines in the courts for years
and that the governor had told them that
there were no more slot machines
available. They said that his
interpretation of the slot machine law
was erroneous and the judge that ruled
for the tribes agreed. He said that the
state needed to give the tribes 10,549
more slot machines.
