No Slot Machines for San Pasqual
The
San Pasqual Band of Mission Indians has
lost their suit against the California
Gambling Control Commission to add more
slot machines. A federal judge has ruled
against the tribe saying that they
cannot add more slot machines to their
Valley View Casino in Valley Center.
The tribe was hoping to get an
additional 10,000 licenses for gaming
devices which would include slot
machines, but US District Judge Larry
Alan Burns dismissed the suit. He said
that he could not allow the case to move
forward as they did not have the support
of the other tribes in the state. He
said that all of the tribes have a
vested interest in the outcome, and that
the other tribes could not be forced to
join either because they were sovereign
entities.
The president of the San Pasqual Casino
Development Group said that they were
very disappointed with the outcome of
the case as they felt that the state had
made erroneous calculations when it came
to the number of slot machine licenses.
The problem they say is that Burns threw
out the suit without taking into
consideration the fact that the tribe
believes that the state has wrongly
calculated the number of slot machines
that are available to the state’s
tribes.
They say the number of slot machines
allowed across the state should be
42,700 – but instead the state has it at
32,151 with all of those licenses issued
already. They said that the tribe should
be allowed more slot machines because
the state has already amended gaming
compacts with five other tribes allowing
them to have more slot machines as well.
