Making Decision
The 1st
District Court of Appeal is here and
ready to hear comments and cases for and
against the law regarding slot machines
in the state of Florida. For what many considered initially
to be an open and shut case with the
state, it has turned out to be a much
bigger deal regarding whether or not
Hialeah Park is going to get slot
machines like the other tracks in the
area have. The question that is before
the court is regarding how specific the
law has been regarding the games and if
they are limited just to the seven that
already have them or if there are others
that qualify as well.
The
seven racinos that already have the slot
machines on their premises say that
there is nothing that will change their
minds as to the fact that Hialeah should not get the slot machines. They
argue that they had to be holding races
in 2006 and 2007 and the track wasn’t so
they do not qualify for the games. They
say that the 2004 constitutional
amendment does not allow for the track
to offer slot machines, and that the law
is very clear in its structure.
However, there are many others that
disagree and they argue that the track
should get them as they fall in the
counties that currently offer them. They
also argue that the law allows for the
state government to bring in slot
machines anywhere else in the state that
it sees fit. The Appeals Court is now
going to have to decide if this is the
case or not, and they so far have said
that the law is fairly unclear so this
should make for a long process.
